Terms of service

These terms apply to every order you place at savaactive.com. Please read them before you buy. By placing an order, you accept them. Nothing in these terms affects your legal rights as a consumer.

1. Who we are

SAVA is an activewear brand based in the Netherlands, selling online at savaactive.com. You can reach us at hello@savaactive.com.

2. Using our website

If you create an account, keep your login details safe; you are responsible for what happens under your account. Please do not use the site for anything unlawful or in a way that could damage or interfere with it.

3. Our products

We do our best to show every piece accurately, but colours can look slightly different from screen to screen. The tops and bottoms of our sets are sold separately unless a product page says otherwise, so the photos may show pieces that are not included in the item you are viewing. Our size guides and fit notes are a guide, not a guarantee. All items are subject to availability.

4. Prices and payment

Prices are shown in the currency displayed at checkout and include VAT where applicable. Delivery costs are shown at checkout before you pay. Orders to some countries may be subject to import duties or taxes on arrival; unless we tell you otherwise at checkout, these are paid by the recipient. Payment is taken when you place your order, using the methods offered at checkout. If we have made an obvious pricing error, we will contact you before your order is sent and you can either confirm it at the correct price or cancel it for a full refund.

5. Your order

After you place an order, we email you to confirm we have received it. The contract between us is formed when we send that confirmation. If we cannot fulfil your order, for example because an item has sold out, we will tell you and refund you in full.

6. Delivery

Delivery options, costs and estimated times are shown at checkout and in our Shipping policy. Delivery times are estimates. Your order becomes yours, and is your responsibility, once it has been delivered to you. If it has not arrived when expected, email us and we will look into it.

7. Changing your mind

You have 14 days from the day you receive your order to cancel it, for any reason. We refund you within 14 days of being told you are cancelling, and may wait until the items are back with us or you have shown us they have been sent. 8. Faulty items

If something you buy from us is faulty, damaged or not as described, you have legal rights under the consumer law of the country where you live. Contact us and we will put it right with a repair, a replacement or a refund, as the law provides. Normal wear and tear, and damage caused by not following the care instructions, are not faults.

9. Discount codes and promotions

Discount codes have no cash value, can be used once per order unless we say otherwise, and cannot be added to an order after it has been placed. We may end a promotion at any time, but this will not affect orders already placed.

10. Our content

Everything on this site, including our name, logo, designs, photos and text, belongs to SAVA or the people who license it to us. Please do not copy or use it without our written permission.

11. Our responsibility to you

We are responsible for loss or damage you suffer that is a foreseeable result of us breaking these terms or failing to take reasonable care. We are not responsible for loss or damage that is not foreseeable. Our products are for personal use, so we are not responsible for any business losses. Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law.

12. Events outside our control

We are not responsible for delays or failures caused by events outside our reasonable control. If one affects your order, we will let you know as soon as we can, and if the delay is significant you can cancel for a full refund.

13. Your privacy

We only use your personal information as set out in our Privacy policy.

14. Changes to these terms

We may update these terms from time to time. The version on our website when you place your order is the one that applies to it.

15. Law and disputes

These terms are governed by Dutch law. If you are a consumer, you also keep the protection of the mandatory consumer laws of the country where you live, and you can bring a claim in the courts there. If something has gone wrong, please email us first; we will do our best to sort it out quickly.
